LIABILITY WAIVER, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

PLEASE READ THIS DOCUMENT CAREFULLY. BY SIGNING THIS FORM, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE STUDIO MOON, ITS OWNERS, INSTRUCTORS, AND EMPLOYEES.

1. ACKNOWLEDGMENT AND ASSUMPTION OF CERTAIN CERAMICS RISKS

I understand that participating in ceramics, pottery, and studio art classes involves inherent risks. These risks include, but are not limited to: physical exertion; cuts or punctures from carving tools and wire cutters; burns from high-temperature kilns, hot equipment, or melted wax; entanglement in motorized pottery wheels or slab rollers; injuries from lifting heavy clay bags or kiln furniture; and respiratory exposure to raw glaze chemicals or airborne silica dust. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES.

2. RELEASE OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, I HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE STUDIO MOON, ITS OWNERS, INSTRUCTORS, EMPLOYEES, AND AGENTS (COLLECTIVELY, THE "RELEASEES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, OR CAUSES OF ACTION ARISING OUT OF ANY PROPERTY DAMAGE, PERSONAL INJURY, SICKNESS, OR DEATH THAT I MAY SUSTAIN WHILE ON THE PREMISES OR PARTICIPATING IN ANY STUDIO ACTIVITIES. THIS RELEASE EXPLICITLY INCLUDES CLAIMS BASED UPON THE SOLE, JOINT, OR CONCURRENT NEGLIGENCE OF THE RELEASEES.

3. INDEMNIFICATION AND HOLD HARMLESS

I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in studio classes or use of studio equipment.

4. MEDICAL AUTHORIZATION

In the event of an injury or medical emergency, I authorize studio staff to seek and obtain emergency medical treatment on my behalf. I agree that I will be solely responsible for any and all financial costs associated with such medical care.

5. STUDIO RULES AND CONDUCT

I agree to follow all safety protocols, clean-up instructions (to minimize silica dust), and teacher guidelines. The studio reserves the right to terminate my participation immediately and without a refund if I act in an unsafe or disruptive manner.

6. PHOTO AND MEDIA RELEASE

I hereby grant Studio Moon royalty-free, perpetual, and unrestricted permission to take, use, reuse, publish, and republish photographic portraits, pictures, or videos of me (or my child/ward) and my artwork. I understand these images may be used in any and all media, including website publications, social media platforms, and promotional materials, without compensation or prior approval.
